Cherry Creek Properties, LLC provides this FREE Advertising Space on its website for YOU subject to the following Terms of Service, which may be updated by us from time to time without notice.

Cherry Creek Properties, LLC, referred to herein as CCP, grants a limited space for qualified advertisement under the guidelines listed below and you the Advertiser, referred to herein as YOU.

The Real Estate Ad is Free to upload and YOU have NO FINANCIAL OBLIGATION to CCP if the property sells unless formal written agreement exists or YOU & CCP are contracted to do so.

YOU must agree before uploading your online listing.  By agreeing, YOU give CCP permission to contact you from time to time. 

YOU understand that upon uploading your information, it will enter it into the public domain and ALL information YOU upload will be viewable and usable by the public. 

  1. YOU agree that CCP is only providing limited Free advertising space for a limited time, intended for online Real Estate advertising.
  2. YOU agree that no contract exits between YOU and CCP that otherwise would result in an obligation for a fiduciary relationship from CCP to YOU as defined by the Colorado Real Estate Commission. http://www.dora.state.co.us/real-estate/about/enfrcmnt/agency.htm
  3. Neither is CCP acting as a Transaction Broker or Sellers Agent on your behalf without first providing written disclosure defining the broker's duties and responsibilities, as defined by the Colorado Real Estate Commission. http://www.dora.state.co.us/real-estate/about/enfrcmnt/agency.htm
  4. You agree to hold CCP free of any liability resulting from your content and indemnify and hold harmless CCP and its agents for any reason resulting from the Internet Advertising service provided.
  5. CCP does not edit any content that YOU upload.  YOU agree that YOU alone are legally responsible for the content that YOU upload to the internet via CCP website. CCP does not control the Content posted via the FSBO Ad service.

PASSWORD AND SECURITY

  1. You are fully responsible for maintaining the confidentiality of your password and account and are responsible for any and all activity that takes place under your password or account. You agree to immediately notify CCP of any unauthorized use of your account and password or any other breach of account security. CCP will not be liable for any loss or damage that takes place from unauthorized use of your account information. 

VIOLATIONS OF THE TERMS OF SERVICE

The intended use of this FSBO advertisement is for FREE public use for the advertisement of Colorado Real Estate within the rules and regulations of the State of Colorado, federal, and local governing agencies that govern Real Estate Advertisement.  Any other uses would violate the terms of services and will be DELETED. 

  1. YOU agree not to upload any content that is discriminatory in nature and which violates the Federal Fair Housing Regulations. http://www.hud.gov/offices/fheo/  
  2. YOU agree that YOU will not upload, post, email, transmit or otherwise make available any Content that is unlawful, harmful, threatening, abusive, tortuous, harassing, vulgar, defamatory, libelous, obscene or invasive of another's privacy, hateful,  or otherwise objectionable language  which would be deemed “inappropriate” for the advertisement of Real Estate. 
  3. YOU agree that all information, data, text, graphics, photographs, or other materials, are the sole responsibility of the person who originated the content. YOU only and not CCP are exclusively responsible for ALL Content that YOU upload to the FSBO advertisement Service.
  4. You agree not to use any language that would be foreign in nature to the State of Colorado.

Deletion:

  1. All ads are subject to deletion if they violate the Terms of service defined here.

 Approval: 

All advertisements are subject to approval and take up to 24hrs.  to process. This process is used to determine if any content violates our Terms of Service only and is not a screening.  Please take time and care when uploading information and photos because any edits also take an additional 24hrs of processing time. 

  1. YOU agree to delete your AD immediately when either your AD is taken off the market or your transaction has closed.  http://www.cherrycreekprop.com/fsbo/

TERMINATION:

CCP reserves the right to terminate any advertisement at any time.
